By accessing or using the Underburbs website and services (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Underburbs provides statistical analytics on historical property sales data sourced from government records. The Service currently covers New South Wales, Australia. We may expand coverage to additional states and territories in the future.

3. Not Financial Advice

The information provided by Underburbs is for informational and educational purposes only. It does not constitute financial, investment, legal, or tax advice. Property valuations, cycle analysis, and trend indicators are statistical models based on historical data and should not be relied upon as the sole basis for any property purchase, sale, or investment decision.

Always consult a qualified financial adviser, property professional, or legal practitioner before making any property-related decisions.

4. Data Sources

All property sales data is sourced from the official government and public data sources, published under Creative Commons Attribution 4.0 (CC-BY 4.0). While we take reasonable care to process data accurately, we do not guarantee the completeness, accuracy, or timeliness of any information on the platform. Government data may contain errors, omissions, or delays.

5. Subscriptions and Payments

Access to the Service requires a paid subscription. Subscription fees are billed monthly. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. No refunds are provided for partial months.

We reserve the right to change subscription pricing with 30 days' notice. Promotional pricing may be time-limited.

6. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

7. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically download data from the Service
• Redistribute, resell, or sublicense data obtained from the Service
• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure

8. Limitation of Liability

To the maximum extent permitted by law, Underburbs and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
